Many people want to represent themselves for a number of good reasons, cost usually leaving them no choice in the matter, but there is also a desire to prove their case themselves, to have their day in court, or they simply cannot justify the exorbitant costs that Solicitors charge for help. There is nothing wrong in representing yourself, thousands of people do it every day, but it needs to be targeted to work well. You wouldn’t try to fix your car with no knowledge and even an IKEA cabinet comes with instructions to explain what each part goes. Understanding the task ahead of you is a key element in managing to successfully represent yourself.

If you are fortunate enough to have been able to reach an agreement about separating your finances, you are in a very good position in not having to go to court and being able to move on with your lives without going through the stress of a court case.
However, any agreement that you make will not become legally binding unless it has been sent to the court in the appropriate format to be approved by a Judge. This reasonably simple step provides both parties with protection and an assurance that the agreement (now a court order) will be followed and if it is not there are ways to make sure that it is.
Too often while things seem to be going well between you and you feel that you can trust your ex-spouse to do what they say, life moves on, circumstances change and people fall out over what can be trivial situations and silly arguments. The offended party may well dismiss the agreement that you had and you are left with nothing to fall back on.

When you have been cohabiting and the relationship breaks down and you separate the law will not give you the same level of protection that a married couple has. You can make an application to court to divide your assets, but unless you have both contributed equally you are unlikely to get anything close to reasonable. However, it may be a good idea for you to have a Separation Agreement made whereby you both agree to the main issues of how long the children will spend with each of you and how you will divide the household furniture, the equity in the home, the cars and who keeps the dog.
If you separate and were not married, the court will consider a claim to sell and divide the equity in the family home under a law called TOLATA. The process is different to that for a married couple, however the end result is a final once and for all settlement which is legally binding. This area of law is very strict and can be extremely unfair, but it will allow you to get on with your life and know that there will be no comeback in future years which can happen if it is not dealt with.
